Asbestos Legal Matters

After a long struggle in the asbestos legal arena, asbestos legal measures culminated in the 1989 partial ban on the manufacturing, processing, and distribution of most asbestos-containing products. This ban is still in effect.

The December 2020 final TSCA risk evaluation for chrysotile asbestos discovered unacceptable health risks to humans for all current uses of Chrysotile asbestos. The April 2019 rule prohibits the return of these asbestos products to commerce.

Legislation

In the United States, asbestos laws are enforced both at the federal and state levels. Although most industrialized nations have banned asbestos but the US continues to use asbestos in a variety of different products. The federal government regulates the use of asbestos in these products and also regulates asbestos attorney litigation. While federal laws generally are consistent nationwide, state asbestos laws vary according to the state in which they are located. These laws usually restrict claims made by those who have suffered from exposure to asbestos.

Asbestos occurs naturally. It is extracted from ground, usually through open-pit mining techniques and is composed of fibrous strands. These strands undergo processing and are mixed with cement or asbestos Compensation other binding agent to create asbestos-containing material (ACM). A licensed contractor wishing to perform abatement on a building must get a permit from the Iowa Division of Labor. The contractor must also inform Iowa OSHA and the Department of Natural Resources. A fee must be paid for the initial and annual notifications. Those who plan to work at the school environment are also required to provide the EPA abatement plans along with training for their employees. New Jersey requires all abatement firms to have a license issued by the Department of Labor and Workplace Development and all employees to be issued workers or supervisory permits.

Litigation
